Foster Fastpitch Affiliate Program Terms & Conditions

Effective Date: The date you accept these Terms by checking the agreement box during enrollment in the Affiliate Program.

Welcome to the Foster Fastpitch Affiliate Program. These Terms & Conditions (“Agreement”) govern your participation in the program. By applying for or participating in the Affiliate Program, you agree to comply with and be bound by the terms outlined below.

1. Program Overview

The Foster Fastpitch Affiliate Program allows approved affiliates to earn commission by promoting eligible Foster Fastpitch products and programs using a unique affiliate tracking link.

Eligible products may include, but are not limited to:

  • The Velo Code

  • Plyo Ball Sets

  • Add-On Training Programs

  • Digital Products

  • Special Promotions or Limited-Time Offers

Foster Fastpitch reserves the right to add, remove, or modify eligible products at any time without prior notice.

2. Eligibility & Approval

Participation in the Affiliate Program is subject to approval. Foster Fastpitch reserves the right to approve or deny any affiliate application at its sole discretion.

Affiliates must:

  • Be at least 18 years of age

  • Provide accurate contact and payment information

  • Represent Foster Fastpitch professionally and ethically

  • Comply with all applicable laws, including FTC disclosure guidelines

Approval into the program does not create a partnership, joint venture, employment, or agency relationship.

3. Commission Structure

Commission rates are determined by your current standing within the Foster Fastpitch Elite Tiered System.

Affiliate commission percentages range from 5% up to 20% and are based on your approved Elite Tier level at the time of the sale.

  • Commission applies to single-payment purchases only, unless otherwise specified in writing.

  • Recurring subscriptions or memberships (if eligible) will be outlined separately.

  • If your Elite Tier status changes, the updated commission rate will apply to future sales only.

  • Commission is earned only on completed purchases made through your unique affiliate link.

The following are not eligible for commission:

  • Refunded or canceled purchases

  • Chargebacks

  • Fraudulent transactions

  • Self-referrals unless approved in writing

  • Wholesale or bulk orders unless pre-approved

Foster Fastpitch reserves the right to review, adjust, withhold, or reverse commissions in cases of suspected misuse, abuse, or violation of these Terms.

4. Payment Terms

  • Commissions are paid on a monthly basis unless otherwise stated.

  • Payments are issued after the product refund window has closed.

  • A minimum payout threshold may apply.

  • Affiliates are responsible for providing accurate payment details.

Affiliates are solely responsible for reporting and paying any taxes owed on commissions earned.

5. Promotional Guidelines

Affiliates agree to:

  • Use only approved branding, logos, and marketing materials

  • Accurately represent products and avoid misleading claims

  • Clearly disclose affiliate relationships in compliance with FTC guidelines

Required disclosure example:

“This post contains affiliate links. I may earn a commission at no additional cost to you.”

Affiliates may NOT:

  • Run paid advertisements using Foster Fastpitch brand terms without written permission

  • Bid on Foster Fastpitch branded keywords

  • Create unauthorized discount codes

  • Misrepresent product pricing, features, or results

  • Impersonate Foster Fastpitch

Failure to follow promotional guidelines may result in immediate removal from the program.

6. Intellectual Property

All Foster Fastpitch trademarks, logos, images, videos, training materials, and digital content remain the sole property of Foster Fastpitch.

Affiliates are granted a limited, non-exclusive, revocable license to use approved materials solely for the purpose of promoting eligible products.

This license may be revoked at any time.

7. Brand Representation

Foster Fastpitch is built on integrity, education, and leadership. Affiliates agree to represent the brand in a manner consistent with these values.

Foster Fastpitch reserves the right to remove any affiliate whose conduct, messaging, or public representation harms the brand.

8. Termination

Either party may terminate participation in the Affiliate Program at any time.

Foster Fastpitch may immediately terminate participation for:

  • Violation of these Terms

  • Fraudulent activity

  • Misrepresentation

  • Brand misuse

  • Unethical marketing practices

Upon termination, affiliates must immediately cease use of affiliate links, marketing materials, and brand assets.

Unpaid commissions may be forfeited if termination results from violation of these Terms.

9. Limitation of Liability

Foster Fastpitch is not liable for:

  • Indirect, incidental, or consequential damages

  • Technical tracking issues beyond reasonable control

  • Loss of commissions due to platform outages, payment processor errors, or third-party failures

Participation in the Affiliate Program is at your own risk.

10. Modifications

Foster Fastpitch reserves the right to update or modify these Terms at any time. Continued participation in the program after updates constitutes acceptance of the revised Terms.
